Version of 16 October 2026, in force from 1 November 2026 (clause 18). These Terms of Use are an agreement between you and the team that runs Lootera (clause 1). By creating an account, playing, contributing to the project or using the Char Bazaar, you accept these Terms, the Privacy Policy, the Cookie Policy and the Char Bazaar Terms. If you do not agree, do not use the Service. You accept electronically, by creating an account, ticking an acceptance box or confirming a contribution; that acceptance has the effect of a signature, and we keep a record of it (the Account, the moment and the IP address) to be able to show it. The English version is the original and translations are for convenience, except for consumers living in Brazil, for whom the Portuguese version prevails.

Clauses marked like this one limit your rights or ours. Please read them before you accept. Nothing in these Terms removes or limits the rights that the consumer law of your country gives you and that cannot be waived by contract (clause 16).

1. Who we are

Lootera is run by an independent team based in Brazil ("Lootera team", "we", "us"). It is a community project in BETA, not yet run through a company; when it is, these Terms will name it. Before we accept any contribution in Brazilian reais, this clause will name the company that runs Lootera, with its legal name, CNPJ (Brazilian company number) and address, as Brazil's e-commerce rules require (Decreto 7.962/2013, art. 2). Contact: support@lootera.net for support and privacy, contact@lootera.net for anything else, or the support channel of the official Lootera Discord. Our servers are hosted in the United States.

2. Definitions

(a) "Service": the Lootera game, its websites, the Store, the Char Bazaar and related content; (b) "Account": your registration in the Service; (c) "Character": a playable character in an Account, with its level, skills, items, gold, outfits, mounts and progress; (d) "Virtual Content": Characters, items, gold, Lootera Coins and any other goods, currencies or advantages that exist only inside the Service; (e) "Lootera Coins" or "Coins": the Service's in-game credits; (f) "Crypto Assets": digital assets on public blockchains, such as SOL and USDC.

3. A self-sustaining fan project in BETA

Lootera is an independent fan project: the contributions it receives pay for its servers, development, security and community events, so the game can keep running for its players. It is not affiliated with, endorsed by or sponsored by CipSoft GmbH. Tibia is a registered trademark of CipSoft GmbH; its sprites and assets belong to their owners. The Service is in BETA: it is still being tested and may contain errors, lose progress, roll back data or be unavailable. We fix problems as fast as we reasonably can.

4. Who can play, and your Account

You must be at least 18 years old, or have reached the minimum age for using online services in your country (at least 13) and have the permission and supervision of your parent or legal guardian, who accepts these Terms on your behalf and is responsible for your contributions. You sign in through third-party providers (such as Google, Discord or e-mail). You are responsible for what is done with your Account and must keep access to it secure. At most 2 Accounts may be connected from the same IP address, and connections through VPNs, proxies or hosting providers are refused, as set by the game's rules. You may not use the Service where doing so is prohibited by law, or if you are subject to sanctions that prohibit dealing with us.

5. A license, not ownership

You do not own the Account, the Characters or any Virtual Content. We grant you a personal, limited, non-exclusive, non-transferable and revocable license to use the Service and its Virtual Content for entertainment, under these Terms. Virtual Content has no monetary value, cannot be redeemed for money and can only be transferred in the ways the Service itself offers. This does not affect what you are entitled to under clause 9 or under mandatory law.

6. Lootera Coins: in-game credits, not money or crypto

You can receive Lootera Coins as a thank-you for a contribution (clause 7) and in the other ways the Service may offer. Coins are credits for use inside Lootera only, recorded in our game database. They are not a crypto asset or token (they do not exist on any blockchain and cannot be sent to a wallet), not electronic money, not a deposit, not a security and not an investment.

VIP time and other timed benefits start when they are activated and end on their own when their time runs out, whether or not the Account is played in that period. Coins do not expire through inactivity.

Coins earn no interest and have no guaranteed value, liquidity, buy-back or conversion: we never redeem, buy back or exchange Coins for money or Crypto Assets, and we make no promise that Coins or any Virtual Content will keep or gain value. When players give Virtual Content a value among themselves, it comes from their own supply, demand and decisions (clause 10).

7. Contributions and bonus Coins

Contributions are voluntary and help keep Lootera running. As a thank-you, a confirmed contribution is credited with bonus Coins, in the amount shown before you contribute. You can contribute:

(a) in Brazilian reais, by Pix, where the contribution page offers it, through the payment provider named on that page. A Pix charge has a deadline shown on screen; a charge not paid in time expires and credits nothing. The details a Pix charge requires (such as name, CPF and e-mail or phone) go to the payment provider for that charge only;

(b) in SOL on the Solana network, at the amount in SOL shown on the contribution page (the USDC value converted at that moment's market price, valid for the time shown). Network fees are paid by you.

A contribution gives no share, prize, return or right in the project beyond the bonus Coins. Bonus Coins are credited to the Account you chose as soon as the payment provider (Pix) or the network (SOL) confirms the payment (usually within minutes; a fraud review may delay it). The number of bonus Coins credited is the one on the offer when the charge was created: changes to prices or offers apply only to later contributions. Contribute only through the Lootera contribution page; for SOL, with the exact amount, network and asset shown: an amount sent from an exchange, on another network, in another token, or outside the page is not credited automatically, and recovering it depends on a request to support and may not be possible.

Crypto transfers are final: once sent, they cannot be reversed by anyone, including us. Crypto Assets are volatile; the amount in SOL is a quote for that moment. You are responsible for the tax, currency and regulatory obligations of your own country.

8. Right of withdrawal

If you live in Brazil, you may withdraw from a contribution within 7 days of the payment (Código de Defesa do Consumidor, art. 49) by writing to support. We return the amount by the same means of payment and remove from the Account the bonus Coins of that contribution; if some of them were already used, the return takes that into account, within the limits the law allows.

Outside Brazil, where the law of your country treats a contribution with bonus Coins as a distance purchase with a right of withdrawal (for example, 14 days in the EU and the UK): bonus Coins are digital content supplied immediately, and by asking us to credit them right away, you expressly agree that delivery starts at once and acknowledge that, where the law allows, you lose that right once the Coins are credited. Before they are credited, you may cancel by writing to support. Where your country's law gives you a right of withdrawal that cannot be lost this way, that law applies.

9. Refunds, fraud and payment disputes

We return a contribution, in bonus Coins, by Pix to the account that paid (for a Pix contribution) or by re-sending the Crypto Asset you sent (at our choice, unless your law says otherwise), when: (a) you contributed through the contribution page and the bonus Coins were not credited because of a fault on our side; (b) the same contribution was sent twice by mistake; or (c) the law of your country requires it. Write to support@lootera.net with the transaction identifier within 30 days. Outside these cases, contributions whose bonus Coins were credited are not returned. If we close the Service for good, clause 13 applies.

Contribute only with a means of payment you are entitled to use: using someone else's without their permission is fraud, whatever the amount. If you think a charge was not made by you, contact support before disputing it; we can act on a compromised Account quickly.

A payment disputed in bad faith after its bonus Coins were credited and used (with your bank, through Pix's special refund mechanism (MED), or with a card issuer) may lead to the removal of those Coins and of what was bought with them, the suspension of the Account and the refusal of new contributions. Where the Coins were already spent and cannot be removed, the balance may go negative until it is settled.

10. Store, Roulette Room, Char Bazaar and trades between players

Store offers, prices in Coins and rules may change. The Char Bazaar works only with Lootera Coins inside the game and is governed by the Char Bazaar Terms; it is the only permitted way to move a Character between Accounts. Selling, buying, lending or sharing Characters or Accounts by any other means is prohibited.

The Roulette Room is only for players aged 18 or over. Each pull of a machine uses one Roulette Coin, bought in the Store with Coins or won in the Room. The result is drawn on our server before the machine spins; the animation only shows it. The chances of each machine and of each prize tier are shown before you pull; changes to chances or prizes apply only to later pulls and are shown on the machine first. If the law of your country prohibits paid random rewards, you may not use the Roulette Room.

Roulette prizes are Virtual Content like any other: they have no monetary value, and Coins won in the Room, like all Coins, are never exchanged for money or Crypto Assets by us (clause 6).

Players may trade items, gold and Coins among themselves inside the game. Any deal that players make outside the Service (for example, paying each other money or Crypto Assets for Virtual Content) is between them alone: we are not a party to it, do not hold or transmit their funds, do not guarantee it, do not settle disputes about it and cannot recover money or Virtual Content lost in such a deal. We may act on Accounts involved in fraud, money laundering, stolen accounts, charged-back payments or other unlawful conduct.

11. Rules of conduct

You must not: use bots, scripts or automation the Service does not itself offer; exploit bugs instead of reporting them; attack, overload or access our systems without permission; collect other players' data; commit payment fraud; harass others, post hate speech or unlawful content; or infringe anyone's rights. Breaking these rules may lead to a warning, removal of Virtual Content obtained through the breach, suspension or closure of the Account. We act in proportion to the breach, tell you why, and you can contest the decision through support.

12. Changes to the game

Lootera is a live game: we may change, rebalance, add or remove features, rules, prices and Virtual Content to keep it fair, working and lawful. We will not make changes whose purpose is to take away what you paid for without reason. Material changes are announced on our official channels.

13. Suspension or end of the Service

We may suspend the Service for maintenance or security, and we may close it for good, for example if it cannot cover its costs. We will announce a closure at least 30 days in advance whenever possible, and stop accepting contributions from the announcement. When the Service closes, your license ends. Coins and Virtual Content have no cash value and are not refunded on closure, except that contributions made in the 30 days before the announcement whose bonus Coins were not yet used are returned on request, and except where the law of your country says otherwise.

14. Warranties and liability

To the extent the law allows, the Service is provided "as is" and "as available", without warranties that it will be uninterrupted or error-free. To the extent the law allows, we are not liable for indirect or consequential loss, lost profits, changes in the price of Crypto Assets, deals between players or failures of third parties (sign-in providers, blockchains, wallets, hosting), and our total liability to you is limited to the amount you contributed in the 12 months before the event. None of this limits liability for death or personal injury caused by negligence, for fraud or wilful misconduct, for gross negligence, or any liability that cannot be limited under the law that applies to you.

For consumers living in Brazil, this clause applies only as far as the Código de Defesa do Consumidor allows (art. 51, I).

15. Intellectual property

The code, the Lootera name and logo, texts and original creations of the Service belong to the Lootera team. Third-party trademarks, sprites and assets belong to their owners and are used in a fan project. Hunt data comes from TibiaWiki under the CC BY-SA license.

16. Applicable law, your consumer rights and disputes

These Terms are governed by the law of Brazil. If you are a consumer, you also keep the protection of the mandatory rules of the country where you live: choosing Brazilian law never takes those away.

Please contact support first: most problems are solved there. If not:

(a) European Union and United Kingdom: you may bring a claim in the courts of your own country, and use the consumer bodies and alternative dispute resolution entities of your country.

(b) Brazil: the Consumer Defence Code (Código de Defesa do Consumidor) and the LGPD apply to you, and you may bring a claim in the courts of your domicile, or through consumidor.gov.br or Procon.

(c) Other countries of Latin America: the mandatory consumer and data protection rules of your country apply, and you may use the courts and consumer authorities of your country where its law gives you that right.

(d) United States: any dispute will be resolved by binding individual arbitration under the Consumer Arbitration Rules of the American Arbitration Association, except that either of us may bring an individual claim in small claims court. Claims may be brought only individually, not as a plaintiff or class member in a class or representative action, and there is no jury trial. You may opt out of this arbitration clause by e-mailing contact@lootera.net within 30 days of first accepting these Terms.

(e) Elsewhere: the courts of Brazil, without prejudice to mandatory rules that give you the right to sue in your own country.

17. Personal data

We process personal data as described in the Privacy Policy. We do not sell personal data and do not use it for advertising.

18. Changes to these Terms

We may update these Terms. The current version is always on this page, with its date. We will announce material changes on our official channels at least 15 days before they apply; if you do not agree, you may stop using the Service and close your Account. Changes never apply to contributions made before them.

19. General

If a clause is held invalid, the rest remain in force. Not enforcing a clause is not a waiver of it. You may not transfer your rights under these Terms except through the Char Bazaar; we may transfer them to a company that takes over the Service, without reducing your rights.
